Terms of Service

These Terms govern your use of PITCH YOUR GAME, a platform for football profiles, posts, ratings and direct messages.

1. Provider and contract

PITCH YOUR GAME is provided by Marvin Neumann, Folkets Parksgatan 8, 582 46 Linköping, Sweden (“PITCH YOUR GAME”, “we”, “us”). PITCH YOUR GAME is the product name. Contact: support@pitchyourgame.de.

Your contract with us is formed when you actively accept these Terms during registration and create an account. PITCH YOUR GAME is currently free of charge. If we later offer paid features, you will receive separate price and contractual information before buying; these Terms alone do not create a payment obligation.

2. Who may use PITCH YOUR GAME

You must be at least 16 years old. If you are under the age of majority, you may only use PITCH YOUR GAME with your legal guardians' consent where that consent is legally required. You may only use PITCH YOUR GAME if you can legally enter into this contract and your account has not previously been suspended for serious or repeated violations.

Accounts are personal. Provide authentic and non-misleading information, do not impersonate another person, club or organisation, keep your credentials secure and inform us promptly if you suspect unauthorised access.

3. Visibility and core features

PITCH YOUR GAME is a social network in which signed-in users can view profiles, Pitch Cards and social connections. For each post, you choose whether it is visible to all signed-in members, only your followers or only people you follow. Comments and ratings inherit the visibility of their post. Your date of birth, email address, settings, push token, block list and private messages are not part of your public profile.

Direct messages may start as requests. Participants can read their messages. Authorised PITCH YOUR GAME team members can read support conversations. A private user-to-user conversation is reviewed only when an open report exists for that exact chat; access is role-restricted and logged.

4. Your content and the licence we need

You retain your rights in content you upload. For the duration of publication, you grant us a non-exclusive, worldwide and royalty-free licence to host, reproduce, technically adapt, transmit and make your content available solely as needed to operate, secure and display PITCH YOUR GAME to the users you choose.

The licence generally ends when you delete the content or your account. Technical backups may continue until the applicable backup cycle expires. We cannot retrieve copies that other users lawfully made outside our control. This clause alone does not permit us to use your content in external advertising; we will request separate permission for that.

Only publish content for which you have all required rights and permissions, particularly photographs or video of other people, club logos, music, match footage and content involving minors.

5. Prohibited content and conduct

The detailed Community Guidelines also form part of this contract. In particular, you must not:

• publish unlawful content, threats, incitement to violence, hate speech, harassment, bullying or sexual exploitation;
• infringe copyright, trade marks, personality, privacy, data-protection or other rights;
• impersonate others or falsify sporting evidence or club affiliations;
• spam, defraud, distribute malware, scrape automatically, evade restrictions or attack PITCH YOUR GAME;
• publish another person's highly sensitive data, such as private addresses, credentials or health data, without a valid legal basis.

6. Reports and moderation

You can report profiles, posts and comments directly in the app. For unlawful content, you may also email support@pitchyourgame.de. Identify the specific content or profile, explain why you believe it is unlawful, provide a means of contact and confirm in good faith that your information is accurate and complete.

We generally review reports manually and consider context, severity, frequency and the rights of everyone involved. We currently do not use an automated system that alone decides whether to remove content or suspend an account. Measures may include reduced visibility, removal, feature restrictions, warnings, temporary suspension or termination. We may act immediately where there is an urgent risk, serious infringement or attempted manipulation.

Affected users generally receive an understandable statement of reasons where legally and safely possible. You may request a new human review within six months by emailing support@pitchyourgame.de. Statutory remedies remain unaffected.

7. Sorting, recommendations and automated systems

The feed currently shows mainly recent posts in chronological order. Search and contact suggestions may also use search input, profile information, roles and existing follow or contact relationships. Blocked or suspended accounts and unavailable content are hidden. PITCH YOUR GAME does not sell placement and currently does not use personalised advertising.

Technical systems may restrict uploads, file types, requests and access patterns under fixed security rules. They do not currently make the final decision alone to remove content or suspend an account. Material moderation decisions are reviewed by a human.

8. Availability and changes to the service

PITCH YOUR GAME is under active development. We do not promise uninterrupted availability. We may change, add or discontinue features where this is necessary for security, legality, technical development or reasonable product design and is reasonable for you. Statutory rights already acquired remain unaffected.

9. Term, termination and account deletion

The contract runs indefinitely. You may terminate it at any time without notice by selecting Profile → Settings → Delete account, or by contacting us.

We may terminate or suspend an account for cause, including serious or repeated violations, risks to other users or the platform, or legal obligations. Where circumstances allow, we will inform you beforehand and provide an opportunity to respond.

10. Statutory rights and liability

Statutory conformity and consumer rights apply. We are liable without limitation for intent and gross negligence, injury to life, body or health, product liability, and any express guarantee.

For a slightly negligent breach of a material contractual obligation, liability is limited to damage that was typically foreseeable when the contract was made. Liability for other slight negligence is excluded to the extent permitted by law. Users are initially responsible for their content; PITCH YOUR GAME's statutory duties remain unaffected.

11. Changes to these Terms

We will inform you in good time of material changes in the app or by email. If a change materially affects your contractual position, we will ask for renewed active acceptance. Changes required by mandatory law or an immediate security risk may take effect sooner. The current version remains publicly available.

12. Governing law and dispute resolution

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, mandatory protections in the country of your habitual residence remain unaffected. Statutory venues apply.

We are not obliged and currently do not agree to participate in proceedings before a consumer dispute-resolution body.

13. Withdrawal information for consumers

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving a reason. The withdrawal period is fourteen days from the date the contract is concluded.

To exercise your right, inform Marvin Neumann, PITCH YOUR GAME, Folkets Parksgatan 8, 582 46 Linköping, Sweden, email support@pitchyourgame.de, through a clear statement, such as a letter or email. Sending the statement before the period expires is sufficient.

Withdraw from contract

Effects of withdrawal

If you withdraw, we end your PITCH YOUR GAME contract and delete your account and related live data as described in the Privacy Policy. PITCH YOUR GAME is currently free, so there are no payments to refund. Legal retention duties and temporary backup copies remain unaffected.

14. Final provisions

If a provision is invalid, the remaining provisions remain effective and statutory law replaces the invalid provision. Individual agreements take priority.
